The first thing to know

After a crash in Texas, the at-fault party (and their insurer) is responsible for your damages. But the insurer will try to pay you as little as possible, or blame you. Having someone on your side from the start changes how much you receive.

What should I do right after a car accident?

What you do in the first hour protects your health and your case.

  • Call 911 and request a police report, even if the impact seems minor.
  • Take photos of everything: the cars, plates, positions, the street.
  • Get medical care the same day, some injuries do not hurt at first.
  • Do not accept or sign anything from the insurer without advice.

Why so many accidents on Expressway 83?

Expressway 83, which everyone in the Valley simply calls "la 83", is the backbone of traffic between Mission, McAllen, Pharr, San Juan, and Weslaco. It packs cars, border-crossing cargo trucks, and local traffic onto the same road.

That mix, plus fast merges and high volume, helps explain why Hidalgo County logged 16,601 crashes in 2024, according to TxDOT. If it happened to you on la 83, we know that road well.

How does the insurer work against me?

The other driver's insurer is not your friend. Its job is to close your case paying as little as possible. They use several tactics:

  • Calling you quickly to get a statement they later use against you.
  • Offering a low settlement before you know how serious your injuries are.
  • Suggesting you were partly at fault, to apply the 51% rule.
Do not deal with the insurer alone
Once you accept a settlement, you cannot reopen the claim, even if your injuries turn out worse than you thought. That is why it is worth reviewing any offer with a lawyer before signing.

What if they say it was partly my fault?

Texas follows the 51% rule: you can recover compensation as long as your responsibility is 50% or less. If they assign you 51% or more, you get nothing. That is why the insurer tries to raise your percentage of fault, and why fighting that percentage matters so much.

How long do I have to file a claim?

In Texas, you generally have two years from the accident date to file an injury lawsuit. It sounds like a lot, but evidence (witnesses, cameras, records) vanishes fast. The sooner you start, the stronger your case.
